WC rules vary by state. You file in the state in which you are based. In IL, you don't get paid for the first 3 days that you are off unless you are off for more than 14 days. In OH, those numbers are 7/14 days. In VA, those numbers are 3/7 days. And in WI, you don't get paid for the first 7 days unless you are off for more than 7 days.

File a FAIR (Flight Attendant Irregularity Report) report for the incident and a FA Injury Report if injured. You can also file an ASAP report if you think a regulation was broken (check standard for ASAP reporting). Find all forms on "ReportIt!" app on IMD or Online via Alaska's World, Safety, ReportIt! Should be reported within 24 hours of the end of the sequence.

How much time do I have to file a Workers' Compensation (WC) claim? How do I file?

You must file a claim within 24 hours in the state in which you are based. Your claim does not officially begin until you see a medical provider. First, inform an Inflight Supervisor ASAP. If base office is closed, contact Crew Scheduling and ask for MOD. Your supervisor will report your claim to the WC vendor and will provide you with a claim number. You can search the Medical Provider Network for a doctor on the Absence Management page.

How many days of Workers' Compensation (WC) leave are unpaid (by state) before I am eligible to be paid for all lost work time?

You are only eligible for WC benefits if the doctor certifies that you are totally disabled. Each state has a 3-day waiting period for time loss compensation which is only paid if your leave exceeds 28 days (AK) or 14 days (OR, WA). It is not paid in CA. You must submit a physician's statement or Activity Prescription Form to [email protected].

Can I take oxygen during a fume event, if necessary?

If you are in a fume event and have symptoms of hypoxia, you can take oxygen. Also, time-permitting, you are required to contact MedAire. You should not be disciplined for using oxygen if you give a reasonable explanation for why you did so. You are considered incapacitated unless you have fully recovered by the time you need to return to your jumpseat. If the flight is full, the other flight attendants will look for an able-bodied passenger to sit in the jumpseat. You would be moved to the open passenger seat. The FAM includes procedures for using onboard oxygen, but they are not specifically related to fume events.

Fill out CERS (Cabin Event Reporting System) form which can be located on tablet or at my.envoyair.com on the flight service page. The FA should report upon landing. The FA has the option to fill out a report weeks or months after an incident, but the likelihood of that report being approved goes down the longer you wait. Parts 1 and 2 of the IOD (Injury-on-Duty) form is filled out by the FA manager once they receive it from the FA. There is no fixed deadline but they try to fill it out and submit it promptly.

FA file a WC claim at their base, which may not be where they live. So, if your domicile is ORD, then you file a claim in IL. The "notification and investigation report" form which is posted at my.envoyair.com under "departments" and "human resources." They can also contact their manager directly.

The first three days are unpaid and then they are eligible to be paid from day four onward if they have been seen by a physician, and the physician confirms that the sx are related to fumes. The first medical visit is always paid for, regardless of diagnosis. If a claim is approved, then the lost work time is compensated, but only as a fraction of their pay. And the first three days are only compensated if the FA has been out for more than 14 days then the first three days are paid.

FA can use sick time. If the WC claim is not approved then the FA accrues points. However long they are originally out for WC counts as one point. Other times they need to miss work for the same claim will count as another point, unless they're able to get covered by FMLA or medical leave.

In the interest of getting prompt care, FA can see a doctor of their choice at first. However, per the contract, "the direction of medical care will be governed by each state's specific workers' comp statutes and guidelines. That means that FA have the right to use their own personal physician to diagnose and treat any IOD if they take accept WC claims. Alternatively, Illinois has a list of networks/medical providers that they want workers to use ("preferred provider program"). List is posted at my.envoyair.com under "human resources", "injury-on-duty", and "Illinois-based employees." Then the FA can select location and medical specialty.

Here is management’s position on oxygen use during a fume event (April 2023): “We do not have a procedure for flight attendants to don an oxygen mask in the event of smoke/odor/fumes in the cabin. The cabin oxygen masks (POB and PSU) have openings in the masks that allow the outside [ambient cabin] air to mix with the oxygen, so the exposure to the smoke/odor/fumes would only be reduced, not eliminated, and the flight attendants would have to replace the OPB to take their jumpseat for landing. In most cases, depending on the severity of the situation, the flight will be making an emergency landing and exposure will be brief. [During a fume event], flight attendants should follow Smoke in Cabin procedures and breathe through damp towels to reduce exposure to themselves [and the] passengers. We have reviewed AA’s procedures and they do not have [an oxygen mask policy for fume events] either. They determine any flight attendant who needs to be on supplemental oxygen during a flight outside of a decompression to be incapacitated. In the next revision, we will be updating the IPM with specific procedures for these events to help flight attendants effectively communicate this situation to the flight deck as well as limit exposure to themselves and the passengers.”

Calling Inflight Absence Management and Nurse Triage starts the WC process.

For claims filed in HI and CA, approved claims are paid at 2/3 salary after a waiting period. While a WC claim is pending, the company will pay lost work time (but not during waiting period). For an approved claim, for the first 90 days, the company will pay the difference between WC and average earnings over previous six months. After that (up to one year), you can use sick time to cover the additional 1/3 of your pay. If WC is denied, then you should be able to use available sick time.

During what phase of flight did you develop symptoms? What were the symptoms? Send a copy of the report to the AFA-CWA LEC Safety, Health, and Security Committee.

Delta Organizing

Someone from our committee will respond within 24 hours. Our goal is to build the framework to provide real-time assistance via phone, so stand by for that.

If you have to call off your trip, first call IFS Scheduling at 1-800-DAL-CREW (1-800-325-2739). If you are unwell and need to file an OJI, call Sedgwick (1-877-673-3582). They will give you information on how to file a claim and instructions on how to get medical care if you need it. Your manager may also call you after the Delta rules for notification of sick/OJI have been processed.

You are required to report to Delta SRS (Safety Reporting System); see Ch. 42 of Delta’s In-Flight Programs/Policies handbook. You can file the report on either Deltanet or SkyPro. There are two additional voluntary safety reporting options – ASAP and ASRS; see below. ASAP: The Aviation Safety Action Program is for voluntary self-reporting of safety issues with the goal of preventing future events; see Chapter 6 of Inflight Programs/Policies handbook. If your report is accepted by a committee which includes the FAA and management, then you are not disciplined. The benefit of reporting to ASAP is that it gets the safety issue past "just DL" and in front of the FAA. Also, it is supposed to be non-punitive. ASRS: You can also report to the ASRS (Aviation Safety Reporting System) which is an independent, confidential system managed by NASA. The benefit of reporting to NASA ASRS is that it gets safety information into the wider aviation community.

If you are a line holder, then the company will apply your accrued PPT to the time that you miss. This can include the rest of your trip and the days that follow if you are sick from the fume event and file an OJI. If you have no PPT, then you do not get paid for that time. You do not have the option to get your lost work time paid by workers’ comp benefits unless you are signed out for longer than the “waiting period” (varies by state; see #5) and your claim is approved. Discipline is possible but policies do not appear to be applied consistently. As of this writing, the Delta Onboard Manual (Sec. 4.2.55) instructs flight attendants to take oxygen for first aid purposes, if affected by smoke/fumes. If you are sick, AFA does not concur with Delta's advice to wait to contact EMS until you have breathed fresh air for 15 minutes.
